RULES




INTRODUCTION 

1          These Rules are made under the Articles of Association (“the Articles”) of Kent Golf Union Limited (“the Union”).  In the event of any inconsistency between these Rules and the Articles, the Articles shall prevail.


MEMBERSHIP OF THE
UNION
 

Voting Members 


2          The Golf Clubs entitled to apply to become affiliated to the Union under the Provisions of the Articles shall be:

 

(i)         recognised Golf Clubs with a wholly or partly male membership owning or occupying a course of courses in or adjacent to the County of Kent; and

 

(ii)        other Golf Clubs with a wholly or partly male membership not owning or occupying but never the less regularly playing upon a particular course or courses in or adjacent to the County of Kent.

 

3          Each Golf Club that, at the date of incorporation of the Union, was a Council Member of the unincorporated association known as the Kent County Golf Union and each Golf Club whose application for affiliation to the Union is accepted by the Board shall be an “Affiliated Club”.

 

4          A Golf Club wishing to become affiliated to the Union, shall apply in writing to the Union in the form determined by the Board and the application shall be considered and decided by the Board. If the application is accepted, the Golf Club shall be an “Affiliated Club”.

 

5          Each Affiliated Club shall pay an annual subscription to the Union.  The amount of the subscription for each Club for each calendar year and the due date of payment thereof shall be determined by the Board from time to time. No Affiliated Club whose subscription is in arrears and no member of any such Club shall (unless the Board decides otherwise) be entitled to take part in any championship or other meeting of the Union.

 

6          Any Affiliated Club wishing to withdraw from the Union must give notice thereof in writing to the Secretary on or before the 30th November in any year; failing which the Club shall be liable to pay its subscription for the ensuing year.

 

7          Each Voting member that is an Affiliated Club shall give notice to the Union of its nominated representative in respect of each general meeting. Such notification shall be given to the County Secretary either by email not less than six hours before the start of the general meeting or in writing signed by an appropriate authorised official of the Voting Member at the start of the general meeting.


Playing Members
 


8          Each person who, at the date of incorporation of the Union, was an Individual County member of the unincorporated association known as the Kent County Golf Union and each individual whose application for playing membership of the Union is accepted shall be a “Playing Member”.

 

9          Individual male members of Affiliated Clubs may become Playing Members by applying for membership in writing on the appropriate form to the County Secretary and such applications shall be considered and decided by him. Any such member may appeal from such decision to the Board, whose decision shall be final.

 

10        Subject to Rule 11, each Playing Member shall pay an Annual Subscription to the Union.  The amount of such Annual Subscription shall be as the Board may from time to time determine. Each Playing Member’s first subscription shall be due and payable within two months of demand for it by the Union, and his second and subsequent annual subscriptions shall be due and payable on 1st January in each year. If, at any time, the Playing Member has not paid his subscription within two months of the due date he shall render himself liable to exclusion from Playing Membership and the Board may, at any time, terminate his membership accordingly.

 

11        Any Playing Member may at any time become a “Life Playing Member” by paying to the Union the appropriate age group Subscription, following which no further subscription shall be payable in respect of that member’s Playing Membership. The amount of these subscriptions shall be as the Board may from time to time determine. Each person who, at the date of incorporation of the Union, was a Life Member of the unincorporated association known as the Kent County Golf Union shall be a Life Playing member of the Union.

 

12        If a Playing Member ceases of his own accord to be a playing member of an Affiliated Club he shall thereby become an “Associate Playing Member” subject to the membership criteria and restrictions set out below. If membership of an Affiliated Club is for whatever reason withdrawn from a Playing Member by the ruling organisation of that Club, he shall cease to be a Playing Member of the Union altogether.

 

13        As Associate Playing Member shall pay the same dues and have the same rights as a Playing Member, except that he shall not be entitled to participate in the County Card Scheme. If an Associate Playing Member becomes a playing member of an Affiliated Club, on application to the County Secretary, he shall automatically be reinstated as a Playing Member.

 

14        Any Playing Member not being a Life Playing Member, wishing to withdraw membership, must give notice thereof in writing to the Secretary  on or before the 31st October in any year; otherwise he shall be liable to pay the applicable subscription for the ensuing year. No amount of the Subscription paid by a Life Playing member shall be reimbursed upon termination of his membership.

 

15        For the avoidance of doubt, Playing Members, Life Playing Members and Associated Playing Members shall not be Voting Members of the Union for the purposes of the Articles.


THE COMMITTEE
 


16        The Board shall delegate the day to day management of the golfing affairs of the Union and such other matters as it shall determine at its discretion (but not the financial aspects thereof) to one or more Committees of up to twenty persons, consisting of the directors of the Union and such other persons as may be co-opted under Rule 17. No act or proceeding of the Committee shall be deemed invalid by reason of any vacancy on the Committee.

 

17        The Board may co-opt any person (being a member of an Affiliated Club) to fill a casual vacancy on the Committee. Any person so appointed shall hold office until the next Annual General Meeting.

 

18        The Board may appoint one of the directors, other than the President, as the County Captain for such period as it shall determine. The County Captain shall have such rights and privileges as the Board may from time to time prescribe.


Committee Meetings
 


19        Meetings of the Committee shall be chaired by the President, or if he is not present by a Vice President or a Past President, or if none of these officers are present or willing to chair the meeting, by a member of the Committee selected by those present.

 

20        At Meetings of the Committee, the quorum shall be as set by the Board and, unless the Board decides otherwise, shall be three. Each question shall be decided by the majority of those present and voting on the question. In case of equality of voting, the Chairman of the Meeting shall have a casting vote.

 

21        The Committee shall make and may from time to time repeal and vary By-Laws for the regulation of the Championship Meeting and other Meetings of the County, and shall decide what competitions shall be played at such Meetings, and the conditions under which the same shall be played and, in consultation with the Board, the entrance fees to be paid therefore; and shall select the players to represent the County in Golf Matches.

 

22        The Committee may admit to any competition at any Championship Meeting in the County any Club of Artisan Golfers or any amateur member of such Artisan Club attached to an Affiliated Club.

 

23        The Committee may delegate to a Sub-Committee any or all of its powers relating to a Championship Meeting or to the selection of players to represent the County in Golf Matches; and may co-opt as a member of any such Sub-Committee, for any period they think proper, any member or members or officer of the Club on whose course the Championship Meeting is to be held. Such Sub-Committee shall have power (in addition to the powers conferred on it by the Rules of Golf) to make such modifications in the By-Laws regulating the Meeting as may be necessary owing to the weather or other unforeseen circumstances.


GENERAL
 

24        Whenever there is a need for Disciplinary Action, potentially affecting the Status of an Affiliated Club, or a Male Golfing Member of an Affiliated Club, the Union and the Club will carry out the “Disciplinary Procedure” as laid down by the English Golf Union.
